01
Parties and Agreement
These Terms and Conditions (“Terms”) govern the relationship between CMMaj LLC, a North Carolina limited liability company (“Company,” “we,” “us,” or “our”), and any individual or family who purchases, books, or inquires about services offered by the Company (“Client,” “you,” or “your”).
By submitting a booking request, completing a payment, or engaging with the Company’s services in any capacity, you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, do not proceed with booking or payment.
These Terms apply to all services offered by CMMaj LLC, including but not limited to the Music School Roadmap session, consulting packages (Small, Medium, and Large Bundles), expert evaluations, prescreening video guidance, audition coaching, and essay editing services.
02
Services
CMMaj LLC provides independent educational consulting services specializing in college music school admissions. All services are delivered by or under the direct supervision of Dr. David Lee Fish, Ph.D., founder and principal consultant.
Services currently offered include:
- The Music School Roadmap — a 50–60 minute consulting session with Dr. Fish, a written 2–3 page assessment document delivered within 48 hours of the session, a personalized resource bundle, and a 15-minute follow-up call scheduled 2–3 weeks after the session.
- Consulting Packages (Small, Medium, and Large Bundles) — comprehensive admissions consulting engagements of varying scope, as described on the Company’s website at collegemusicmajor.com.
- Individual services — expert evaluations, prescreening video strategy, audition coaching, application and essay editing, and related services offered on a standalone basis.
The Company reserves the right to modify, discontinue, or limit any service offering at any time. Clients who have already paid for a service will receive the service as described at the time of purchase, or a full refund if the service cannot be delivered.
03
Fees and Payment
All fees are stated in United States dollars. Current pricing is published on the Company’s website and is subject to change. The price in effect at the time of your payment confirmation governs your engagement.
Music School Roadmap
- Payment is due in full at the time of booking confirmation. Your session is not confirmed until payment is received.
- Payment is processed through Zoho Checkout. By submitting payment, you authorize the charge to your designated payment method.
Consulting Packages
- Package fees are as published on the Company’s website at the time of engagement.
- Payment plans (installment arrangements) are available on all consulting packages at no interest and no additional fees. The specific schedule is agreed upon at the time of enrollment.
- A deposit or first installment payment may be required to secure your enrollment.
Flat-rate policy
All fees are flat-rate and apply equally to all clients regardless of geographic location, household income, or any other personal or demographic characteristic. The Company does not engage in income-based or location-based pricing.
04
Cancellation and Refund Policy
Music School Roadmap — No Refunds
All sales of the Music School Roadmap are final. No refunds will be issued for any reason, including but not limited to: cancellation by the client after payment, failure to attend the scheduled session, dissatisfaction with the session outcome, or change of mind.
Consulting Packages
- If a client cancels a consulting package engagement before the first session has occurred, a refund of amounts paid less a 25% administrative fee will be issued within 14 business days.
- No refunds will be issued after the first consulting session has taken place. Work product delivered (written assessments, school lists, essay edits, etc.) remains the property of the client.
- If the Company is unable to fulfill a consulting package engagement due to circumstances within the Company’s control, a full refund of amounts paid will be issued.
Company-initiated cancellations
The Company reserves the right to cancel or decline any engagement at its sole discretion prior to the first session. In such cases, a full refund of any amounts paid will be issued within 7 business days.
05
The 60-Day Credit Policy
Clients who purchase the Music School Roadmap and subsequently enroll in any consulting package within 60 calendar days of their Roadmap session date are entitled to a credit of the full amount paid for the Roadmaop toward the total package fee.
- The credit applies to the net package fee and will be deducted from the first payment or deposit due at enrollment.
- The credit is non-transferable and applies only to the client who purchased the Roadmap.
- The 60-day window begins on the date of the Roadmap session, not the date of payment or booking.
- The credit cannot be combined with any other discount, promotional offer, or price-match arrangement unless explicitly agreed in writing by the Company.
- The credit has no cash value and cannot be redeemed for a refund.
06
Price Match Guarantee
The Company offers a price match guarantee on its consulting packages. If a client presents a written quote or published price from a competing music school admissions consulting service for a demonstrably equivalent service, the Company will match or beat that price.
- The competing quote must be current (dated within 30 days), in writing, and from a named competing service.
- The Company determines, in its sole reasonable discretion, whether the competing service is equivalent in scope, credentials, and deliverables.
- The price match must be requested before the client’s enrollment is confirmed and payment is received.
- The price match guarantee does not apply to the Music School Roadmap.
- The Company reserves the right to decline a price match request if the competing service is not genuinely equivalent.
07
Acceptance Guarantee
The Company offers an acceptance guarantee to clients enrolled in the Large Bundle consulting package who have received a personalized school list developed in collaboration with Dr. Fish (the “Guarantee”). The Guarantee provides that the client will receive at least one offer of admission from an agreed-upon target school on their personalized school list.
- The Guarantee applies only to clients enrolled in the Large Bundle with a personalized school list developed through the Company’s school list process.
- Target schools must be mutually agreed upon in writing before applications are submitted. Schools added by the client without the Company’s input or agreement are not covered.
- The client must follow the Company’s strategic guidance throughout the engagement, including audition preparation, pre-screening video strategy, application timelines, and repertoire selection. Material deviation from the Company’s recommendations voids the Guarantee.
- The Guarantee does not apply if the client’s applications are incomplete, late, or withdrawn by the client.
- The Guarantee does not apply to schools removed from the target list at the client’s request.
- In the event the Guarantee conditions are met and no acceptance is received from an agreed-upon target school, the Company’s sole obligation is to provide an additional consulting engagement at no charge, the scope of which will be determined by mutual agreement. No monetary refund is provided under the Guarantee.
- The Guarantee is personal to the enrolled client and is non-transferable.
08
Client Responsibilities
The success of any consulting engagement depends substantially on the client’s active participation. The client agrees to:
- Provide accurate, complete, and timely information about the student’s musical background, academic record, geographic preferences, and goals.
- Attend scheduled sessions punctually. Sessions missed without 24 hours’ advance notice are forfeited.
- Complete assigned tasks, research, and preparation between sessions in a timely manner.
- Communicate schedule conflicts, changes in the student’s situation, or changes in school preferences promptly.
- Understand that the Company’s guidance is advisory in nature. Final decisions regarding school selection, repertoire, application content, and enrollment remain with the client.
09
Confidentiality
The Company treats all client information as confidential. Information shared by clients in the course of the consulting engagement will not be disclosed to third parties except:
- As required to deliver the services (for example, sharing student recordings with an expert evaluator engaged by the Company for that purpose, with the client’s knowledge);
- As required by law or legal process; or
- With the client’s explicit written consent.
Client information is never sold, rented, or shared with third parties for marketing purposes. Expert evaluators engaged by the Company are bound by confidentiality obligations consistent with these Terms.
10
Intellectual Property
Written materials produced by the Company specifically for a client — including the Music School Roadmap document, school list, and essay edits — are delivered to the client for their personal use in connection with their college music admissions process.
All other materials produced by the Company, including but not limited to the DIY Guide, School Finder, website content, blog posts, templates, and presentation materials, remain the sole intellectual property of CMMaj LLC and may not be reproduced, distributed, or used for commercial purposes without written permission.
11
Limitation of Liability
To the fullest extent permitted by applicable law, CMMaj LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the services provided, including but not limited to: a student’s failure to gain admission to any particular school; decisions made by colleges, universities, or conservatories; or the client’s reliance on the Company’s guidance.
The Company’s total liability to any client for any claim arising out of or related to the services shall not exceed the total fees paid by that client to the Company in the 12 months preceding the claim.
Nothing in these Terms limits the Company’s liability for fraud, willful misconduct, or any liability that cannot be excluded or limited by North Carolina law.
12
Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions.
Any dispute arising out of or related to these Terms or the services provided shall first be addressed through good-faith negotiation. If negotiation does not resolve the dispute within 30 days, the parties agree to submit to mediation before pursuing any other remedy.
If mediation is unsuccessful, any legal proceedings shall be brought exclusively in the state or federal courts located in North Carolina, and both parties consent to the jurisdiction of those courts.
13
Modifications to These Terms
The Company reserves the right to modify these Terms at any time. Updated Terms will be published on the Company’s website with a revised effective date. Continued use of the Company’s services after the effective date of any modification constitutes acceptance of the updated Terms.
Modifications do not apply retroactively to services already purchased and in progress at the time of the modification.
14
Entire Agreement
These Terms, together with any written proposal or engagement agreement provided to the client, constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior discussions, representations, or agreements, whether oral or written.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Acknowledgment
By purchasing a service or submitting a booking request, you acknowledge that you have read, understood, and agree to these Terms and Conditions in their entirety.
